Social Welfare Consolidation Act 2005 section 77

Increase of disablement pension on account of incapacity

Section 77 explains how a person receiving disablement pension qualifies for an additional payment called the incapacity supplement.

  • A beneficiary may receive an increased weekly pension if their work-related injury or illness leaves them permanently unable to work.
  • Even if technically capable of some work, a person may still qualify if their disability restricts their earning capacity to no more than a prescribed threshold.
  • The definition of earnings covers all forms of remuneration and profit from any gainful occupation.
  • The supplement is granted for a fixed period but may be renewed on an ongoing basis.
