Social welfare tribunal

Section 333 establishes the Social Welfare Tribunal, setting out its composition, appointment procedures, powers to take evidence, and the Minister's regulation-making authority.

  • The Tribunal comprises a chairman and four ordinary members appointed by the Minister β€” two nominated by the Irish Congress of Trade Unions and two by an employers' organisation.
  • Members may resign or be removed by the Minister, and vacancies are filled in the same manner for the remainder of the outgoing member's term.
  • The Tribunal can take evidence on oath, compel witnesses to attend and produce documents, and treat false evidence as perjury.
  • The Minister may make regulations covering application procedures, hearing arrangements, representation, decision notification, costs, and the Tribunal's official seal.
