Continuity of insurance under old codes

Section 363 provides for regulations to preserve the social insurance rights of persons who were insured under earlier legislation before 5 January 1953.

• Regulations may be made to ensure that persons insured before 5 January 1953 under the National Insurance Act 1911, the Unemployment Insurance Act 1920, or the Widows' and Orphans' Pensions Act 1935 can continue to be insured under Part 2 or otherwise retain their rights under those earlier laws.
• These regulations may modify the contribution conditions for receiving benefit under Part 2, taking account of contributions paid (or deemed paid) under the earlier legislation and periods of insurance under those laws.
• Additional regulations may be made to facilitate the transition to the insurance system established by the Social Welfare Act 1952, including modifying pre-1953 provisions that were repealed or amended by Part V of that Act.
• Regulations may also make savings or additional savings arising from repeals or amendments carried out by the Social Welfare Act 1952.
