Disqualifications

Section 199 allows welfare authorities to refuse, reduce, suspend or terminate rent or mortgage interest supplements for individuals who have been evicted from, excluded from, or refused social housing due to anti-social behaviour or estate management concerns.

• Applies to people evicted from social housing for anti-social behaviour, refused a housing allocation, subject to excluding orders, or directed to leave accommodation under housing legislation.
• A designated person may decide that someone in these categories cannot receive rent or mortgage interest supplements, or may stop or suspend existing payments.
• Where an affected person lives with someone else receiving such supplements, the supplement amount can be reduced by whatever portion is reasonably attributable to the affected person.
• Decisions must take into account information provided by housing authorities or other specified persons under the Housing (Miscellaneous Provisions) Act 1997.
