Liability to repay where person convicted of offence

Section 337 establishes the liability to repay social welfare payments when a person is convicted of fraudulently obtaining them through theft or fraud offences.

  • Applies when someone is convicted under the Larceny Act 1916 or the Criminal Justice (Theft and Fraud Offences) Act 2001 for receiving social welfare payments they were not entitled to
  • The person must repay the fraudulently obtained amount on demand to either the Social Insurance Fund (for benefits) or the Minister (for assistance and family payments)
  • The maximum repayment amount is limited to the total value of payments covered by the criminal conviction
  • Covers various payment types including benefits, assistance, child benefit, working family payment, continued payment for qualified children, and back to work family dividend
