Weekly rate of payment

Section 235 sets out how the weekly rate of continued payment for qualified children is calculated when a person moves from jobseeker's benefit or jobseeker's allowance into employment.

  • The weekly continued payment equals the child-related increase that was included in the person's jobseeker's benefit or jobseeker's allowance immediately before they started work.
  • The payment relates specifically to each qualified child who normally lives with the claimant.
  • Where the person was on jobseeker's allowance, the continued payment cannot exceed the actual rate of jobseeker's allowance they were receiving.
  • This cap ensures that the continued payment does not produce a higher amount than the person was entitled to while unemployed.
