Disqualifications

Section 147 sets out the circumstances in which a person is disqualified from receiving jobseeker's allowance.

  • A person is automatically disqualified while resident in a publicly-funded institution or while employed on Community Employment or Rural Social Scheme programmes.
  • Disqualification applies during a trade dispute stoppage at the person's workplace, unless they were not participating in or directly interested in the dispute, or have since found other employment.
  • A deciding officer may impose disqualification for up to 9 weeks where a person lost employment through misconduct, left voluntarily without just cause, refused suitable employment, or failed to pursue reasonable job opportunities.
  • Jobseeker's allowance cannot be paid for the same day or days as jobseeker's benefit, jobseeker's benefit (self-employed), or jobseeker's pay-related benefit.
