Liable relative in service of State

Section 353 previously dealt with the recovery of supplementary welfare allowance costs from liable relatives who were employed in the service of the State, but has been repealed.

  • Section 353 originally allowed deductions from the pay of State employees who were liable relatives, to recover supplementary welfare allowance payments made to their dependants.
  • The section provided a mechanism for the Department to notify a State employer and require amounts to be withheld from wages or salary.
  • This provision was part of the broader liable relative framework, under which certain family members could be required to contribute towards the cost of welfare payments made to their dependants.
  • Section 353 was repealed by section 7 of the Social Welfare and Civil Law (Miscellaneous Provisions) Act 2024, removing this recovery mechanism from the legislation.
