Regulations

Section 46D gives the Minister power to make regulations governing disqualification from partial capacity benefit and the rules for giving up and later reclaiming the benefit.

  • The Minister may make regulations disqualifying claimants who fail without good cause to attend medical examinations, follow medical advice, or meet with officials regarding their claim.
  • Regulations may also set out when and how a person can voluntarily give up their partial capacity benefit and later reclaim it.
  • Where benefit is relinquished and later reclaimed, the combined payment period before and after cannot exceed 156 weeks.
  • Regulations may prescribe a shorter maximum period than 156 weeks.
