Duration of payment

Section 54 sets out when health and safety benefit becomes payable and the circumstances in which payment ceases.

• Health and safety benefit becomes payable from the day after the 21st day of employer-paid health and safety leave.
• The benefit continues for the full duration of health and safety leave granted under the Maternity Protection Act 1994.
• The benefit cannot be paid on any day for which maternity benefit is also payable.
• If the woman entitled to the benefit dies, no further payments are made.
