Regulations in respect of persons to whom section 40(7) applies

Section 40A sets out the Minister's authority to create regulations for Covid-19 related illness benefit provisions, including the consultation requirements and factors that must be considered when making those regulations.

  • The Minister may make regulations after consulting the Minister for Health and obtaining consent from the Minister for Public Expenditure and Reform.
  • Regulations can cover certification procedures, notification requirements for incapacity, and additional conditions for illness benefit entitlement.
  • When making regulations, the Minister must consider the impact of Covid-19 on society, the State's response capacity, resource efficiency, and economic effects.
  • A "relevant person" is someone incapable of work by virtue of Covid-19 as defined in section 40(7) to (12).
