Disqualifications

Section 218 sets out the circumstances in which a farmer is disqualified from receiving farm assist, including participation in certain employment schemes and attendance at courses of study.

  • Farmers cannot receive farm assist whilst participating in specific Minister-provided employment schemes: Community Employment, Rural Social Scheme, Back to Work Allowance, or Part-Time Job Incentive
  • Farm assist is not payable to farmers attending courses of study, except in prescribed circumstances and for specified periods
  • Definitions of "academic year", "course of study" and "institution of education" are taken from section 148(2)
  • Farmers are deemed to be attending a course of study during the three months following completion of secondary education, throughout an academic year, and during breaks between academic years (excluding the final year)
