Transfer of certain property

Section 208 provides for the transfer of property, legal rights, and ongoing contractual obligations from former public assistance authorities to the Health Service Executive (HSE).

• Property originally held by public assistance authorities and transferred to health boards in 1977 must now be re-registered in the HSE's name upon request.
• The HSE can enforce legal claims (choses-in-action) inherited from health boards without notifying the party who owes the obligation.
• Bonds, guarantees, securities, and unfinished contracts from before 1 July 1977 now operate as if the HSE's name had been written into them from the start.
• These provisions do not apply to any assets or obligations already designated and transferred under Part 4 of the Social Welfare and Pensions Act 2010.
