Continuance of officers, instruments and documents

Section 362 provides for the continuity of officers and legal instruments from repealed social welfare enactments, ensuring they remain valid under the 2005 Act.

• Officers appointed under previous social welfare legislation continue in office as if appointed under the 2005 Act.
• Legal instruments and documents made under repealed enactments remain in force under the 2005 Act.
• The continuity covers enactments repealed both directly and via the Social Welfare (Consolidation) Act 1993.
• Provisions of earlier instruments that have been incorporated into the 2005 Act itself are excluded from this carry-over.
