Interim payments and suspension of payment

Section 334 empowers the Minister to make regulations dealing with interim matters while social welfare claims are being decided, and to suspend payments where doubts arise about a claimant's entitlement.

  • Regulations may be made to address matters that arise while any claim for benefit, assistance, child benefit, working family payment, continued payment for qualified children or back to work family dividend is awaiting a decision, appeal or revision.
  • These regulations can also deal with matters arising from the outcome of any appeal or revision of a previous decision on such claims.
  • Where the Minister considers that a question has arisen or may arise as to whether the conditions for receiving a payment are or were met, the Minister may direct that the payment be suspended in whole or in part.
  • Any such suspension remains in effect until the question in doubt has been decided.
