Regulations

Section 330 empowers the Minister to make regulations setting out the procedures to be followed by deciding officers, appeals officers and designated persons when making decisions or determinations under the social welfare code.

  • The Minister may make regulations specifying the procedures that deciding officers must follow when deciding questions relating to claims, entitlements and related matters.
  • The regulations may also specify the procedures for appeals officers when deciding appeals and revised decisions.
  • Procedures for designated persons making determinations in relation to supplementary welfare allowance may likewise be prescribed by regulation.
  • The section provides the legal basis for the detailed procedural rules that govern day-to-day decision-making across the social welfare system.
