Entitlement to allowance

Section 130 establishes the basic entitlement to guardian's payment (contributory) for orphans and specifies when this payment cannot be made.

• Guardian's payment (contributory) is a social welfare payment available for qualifying orphans.
• Entitlement depends on meeting the contribution conditions set out in section 131.
• The payment remains subject to other provisions of the Act.
• No payment is made where a child is receiving support under Part VI of the Child Care Act 1991, such as care provided through Tusla.
