Appeals to high court

Section 327 provides that a person who is dissatisfied with the decision of an appeals officer, or with a revised decision of the Chief Appeals Officer, may appeal to the High Court on any question of law.

  • A person unhappy with an appeals officer's decision may appeal it to the High Court
  • Similarly, a revised decision of the Chief Appeals Officer may be appealed to the High Court
  • The appeal must be on a question of law β€” disputes purely about the facts of a case cannot be brought to the High Court under this section
  • This right of appeal ensures that legal errors made in the social welfare appeals process can be corrected by the courts
