Interpretation and application

Section 101A defines the key terms used in this Chapter relating to dematerialised securities and establishes the scope and commencement date for these provisions.

  • Applicable securities are transferable securities (or interests in them) that were issued before 1 June 2015 and were admitted to trading or listed on any market, whether regulated or not, in Ireland or elsewhere.
  • A central securities depository is an organisation that holds and settles securities electronically, and a nominee is any body appointed by such a depository to hold applicable securities within its settlement system.
  • A certificate means any document evidencing title to applicable securities, but does not include a register of securities.
  • These provisions apply from 1 January 2025 to any applicable securities issued on or before 1 June 2015.
