Resolutions passed at adjourned meetings of creditors and contributories

Section 685 establishes that resolutions passed at adjourned meetings of creditors or contributories take effect from the date they were actually passed, not from any earlier date.

  • Applies to meetings of creditors or contributories that have been adjourned and reconvened at a later date
  • Any resolution passed at such an adjourned meeting is treated as passed on the actual date of approval
  • The resolution cannot be backdated or deemed to have been passed on the date of the original meeting or any other earlier date
  • This rule applies for all purposes, ensuring a single consistent effective date for the resolution
