Distribution of inspectors' report

Section 759 deals with who may receive a copy of an inspectors' report and how the court controls the distribution and publication of such reports.

  • The court must provide a copy of every inspectors' report to the Corporate Enforcement Authority
  • The court may, on request, provide copies to specified persons including company members, auditors, persons whose conduct is mentioned, and those financially affected
  • The court may publish the report in whatever form it considers appropriate and may share it with relevant regulatory or competent authorities
  • The court may direct that particular parts of the report be omitted from any copy forwarded, provided, or published
