Chairperson

Section 694 sets out the rules for who chairs meetings of creditors, contributories and members during a company's liquidation.

  • When the liquidator summons a meeting, the liquidator acts as chairperson.
  • If the liquidator is unable to act, a person nominated by the liquidator takes the chair.
  • At all other meetings of creditors, contributories or members, the attendees appoint the chairperson by resolution.
  • These rules do not apply to creditors' meetings held under section 587, which governs meetings in a creditors' voluntary winding up.
