Court may require director to give certain information

Section 862 gives the court power to require a director facing criminal charges or civil proceedings related to their company, or involving fraud or dishonesty, to disclose details of their directorships and any disqualification history.

• Applies where a director faces criminal charges or civil proceedings relating to the company or involving alleged fraud or dishonesty
• The court may require the director to lodge a written notice listing all current directorships and any directorships held within the 12 months before the charges or proceedings began
• The notice must also state whether the director is or has ever been subject to a disqualification order, including the dates and duration of each disqualification period
• These requirements apply equally to shadow directors as they do to formally appointed directors
