Supplemental provisions in relation to section 216 β€” "relevant fee", power to alter the amount of it, offences, etc.

Section 217 defines the fees a company may charge for inspection of its registers and provision of copies, sets out offences for non-compliance with register inspection obligations, and gives the Minister power to adjust those fees over time.

  • A company may charge up to €10 to inspect a single register, up to €15 to inspect multiple registers within 24 hours (provided advance notice is given), and up to €10 per copy of a register or document β€” though it may choose to charge less in each case.
  • If a company fails to comply with its obligations regarding the keeping, location, and inspection of registers or the provision of copies, the company and any officer in default commit a category 3 offence.
  • The court may, on application, order a company to allow immediate inspection of a register or to send a requested copy to the person who asked for it.
  • The Minister may adjust the statutory fee amounts by order, but only where changes in the general value of money justify doing so, and must take into account the costs companies incur in facilitating inspections and providing copies.
