Power of inspector to examine officers, agents and others

Section 756 sets out the powers of a court-appointed inspector to examine individuals under oath in connection with an investigation into a company's affairs.

• A court-appointed inspector may examine officers, agents and other relevant persons under oath about the affairs of the company or any related body corporate under investigation.
• An examination of a company's officer or agent may also cover matters relating to a related body corporate, and vice versa.
• The inspector may conduct the examination orally or by means of written questions.
• The inspector may administer an oath, record the answers given by the person being examined, and require that person to sign the written record.
