Companies Act 2014 section 1420

Publication in relation to insolvency proceedings outside the State

Section 1420 extends the publication requirements that apply to domestic insolvency proceedings so that they also apply to insolvency proceedings taking place outside Ireland.

  • The same publication rules that govern domestic insolvency proceedings under Section 711 are extended to foreign insolvency proceedings.
  • The definition of insolvency proceedings for this purpose draws on both the general definition in Section 2(1) and the specific definition in Section 710.
  • This ensures that when a company is subject to insolvency proceedings in another country, the same notification and publication obligations apply as would apply to proceedings within Ireland.
  • The provision originates from earlier legislation β€” specifically Section 227B of the Companies Act 1963, which was introduced by the European Communities (Corporate Insolvency) Regulations 2002.
