Companies Act 2014 section 956

Confidentiality of information

Section 956 required the Director of Corporate Enforcement, former Directors, and officers of the Office of the Director of Corporate Enforcement (ODCE) to keep confidential any information received in the course of their work, with limited exceptions for sharing information with specified authorities. This section has since been repealed.

  • The Director of Corporate Enforcement, any former Director, and officers of the ODCE were obliged to treat as confidential all information received in the performance of their duties.
  • Exceptions to this confidentiality obligation allowed disclosure of information to An Garda SΓ­ochΓ‘na or to other defined competent authorities.
  • Any person who breached this confidentiality requirement was guilty of a category 2 offence under the Companies Act.
  • This section was repealed by the Companies (Corporate Enforcement Authority) Act 2021, which replaced the ODCE with the Corporate Enforcement Authority (CEA).
