Conviction on indictment of offences under transparency (regulated markets) law

Section 1382 sets out the penalties that apply when a person is convicted on indictment of an offence under transparency (regulated markets) law.

  • Offences under transparency (regulated markets) law that are specified as falling within this section may be prosecuted on indictment.
  • On conviction on indictment, a person faces a fine of up to €1,000,000 or imprisonment for up to 5 years, or both.
  • These indictment penalties are in addition to, and do not replace, any penalties available on summary conviction under the relevant transparency law.
  • This is one of the few offences in the Companies Act 2014 that falls outside the standard four-category classification of offences used elsewhere in the Act.
