Hearing of proceedings other than in public

Section 558ZAE allows the court to hear rescue process proceedings in private where the interests of the company or its creditors require it.

• The court may decide to hear all or part of rescue process proceedings in private rather than in open court.
• This power does not replace or limit the court's own existing discretion regarding private hearings.
• The court must be satisfied that a private hearing is required in the interests of justice.
• The justification for a private hearing must relate to the interests of the eligible company concerned or of its creditors as a whole.
