Restriction of this Part

Section 560 establishes that the provisions of Part 11 of the Companies Act 2014 are subject to the overriding requirements of the EU Insolvency Regulation, specifically its general provisions and its rules on secondary insolvency proceedings.

  • Part 11 of the Companies Act 2014 does not operate in isolation but is subordinate to certain chapters of the EU Insolvency Regulation.
  • Chapter I of the Insolvency Regulation, which sets out general provisions, takes precedence over this Part where relevant.
  • Chapter III of the Insolvency Regulation, dealing with secondary insolvency proceedings, also overrides this Part where applicable.
  • This section re-enacts the earlier provision found in section 343A of the Companies Act 1963, carrying forward the same restriction into the consolidated 2014 Act.
