Functions of Director

Section 949 sets out the functions of the Director of Corporate Enforcement, covering the full range of responsibilities from encouraging compliance with company law through to investigation, prosecution, and civil enforcement of obligations imposed on companies and their officers.

• The Director of Corporate Enforcement is responsible for encouraging compliance with the Companies Acts.
• The Director has the power to investigate suspected offences, including through the appointment of inspectors.
• Functions extend to criminal investigation and prosecution, as well as the imposition of fines and sanctions.
• The Director is also responsible for civil enforcement of the obligations, standards, and procedures to which companies and their officers are subject.
