Liability of Authority for acts or omissions

Section 944W provides legal protection from personal liability for members and officers of the Corporate Enforcement Authority when carrying out their functions under the Act.

  • Current and former members of the Authority are shielded from personal liability for damages
  • Current and former officers of the Authority receive the same protection
  • The protection covers acts done, acts purported to have been done, and omissions in the performance of functions under the Act
  • The protection does not apply where the act or omission is shown to have been carried out in bad faith
