Application of sections 1402 and 1403 to companies that are UCITS

Section 1439 extends the rules on court-ordered winding up and court restoration of investment companies so that they also apply, with necessary modifications, to companies that are UCITS (Undertakings for Collective Investment in Transferable Securities).

  • Section 1402, which sets out the circumstances in which an investment company may be wound up by the court, also applies to UCITS companies
  • Section 1403, which deals with the restoration of an investment company to the register by the court, also applies to UCITS companies
  • Both sections apply with any necessary modifications to reflect the particular regulatory framework governing UCITS under S.I. No. 352 of 2011
  • The effect is to ensure that UCITS companies are subject to the same core winding-up and restoration provisions as other investment companies under the Act
