Powers of receiver

Section 437 sets out the broad range of statutory powers available to a receiver appointed over the property of a company, covering both a general power and a detailed list of specific powers.

  • A receiver has a general power to do everything necessary or convenient, in Ireland or abroad, to achieve the objectives of their appointment
  • The section provides a detailed list of specific powers including taking control of property, leasing or selling assets, borrowing, carrying on business, hiring or dismissing staff, and bringing or defending legal proceedings
  • All powers are subject to any limitations contained in the court order or instrument under which the receiver was appointed
  • The granting of these statutory powers to a receiver does not affect the rights of any other person (other than the company) in relation to the company's property
