Prohibition on certain acts unless registered

Section 1486 prohibits a person from acting as, or holding themselves out as, a registered person unless they are properly entered on the public register.

  • No person may act in a capacity reserved for those entered on the public register unless they are actually registered
  • No person may represent or hold themselves out as being a person entered, or entitled to be entered, on the public register unless properly registered
  • The person must both be entitled to registration and have their name duly entered on the register
  • Breach of this prohibition is a category 2 offence
