Trusts not to be entered on register of members

Section 170 prohibits the recording of any trust information on the register of members or on any register maintained by the Registrar.

  • No notice of any trust β€” whether express, implied, or constructive β€” may be entered on the register of members.
  • The keeper of the register of members must not accept or receive any trust information for recording.
  • No trust details may be entered on any register kept by the Registrar.
  • The prohibition applies regardless of the type or nature of the trust arrangement.
