Representation of bodies corporate at meetings held under this Part

Section 558ZAG confirms that the normal rules allowing corporate bodies to appoint representatives to attend company meetings continue to apply during the rescue process for small and micro companies.

  • A body corporate (such as a company that is a member or creditor of another company) may appoint an authorised representative to attend meetings on its behalf.
  • This right of representation applies to any meeting of an eligible company held during the rescue period.
  • The section is stated "for the avoidance of doubt," meaning it simply clarifies that existing rules under section 185 are not displaced by the rescue process.
  • The practical effect is that corporate shareholders or creditors do not lose their usual right to send a representative to meetings just because the company is undergoing a rescue process.
