Companies Act 2014 section 934F

Publication of relevant sanction imposed on specified person, etc.

Section 934F requires the Supervisory Authority (IAASA) to publish details of sanctions imposed on auditors, audit firms or other specified persons on its website, subject to certain conditions regarding court confirmation, appeals, and anonymous publication in specified circumstances.

  • The Supervisory Authority must publish on its website the details of any sanction, the contravention involved, and the identity of the person sanctioned, as soon as practicable after the court confirms the decision or imposes a different sanction
  • Where an appeal is made against a court confirmation or decision, the Supervisory Authority must publish updates on the status or outcome of that appeal as it considers appropriate
  • The Supervisory Authority may publish sanction details on an anonymous basis where named publication would be disproportionate for an individual, would jeopardise financial market stability or a criminal investigation, or would cause disproportionate damage to the person concerned
  • All published details, whether relating to a sanction or an appeal, must remain on the Supervisory Authority's website for a minimum of five years
