Collection of certain data by Registrar

Section 890A requires the Registrar of Companies to collect and aggregate annual data on restructuring, insolvency and related procedures, in compliance with EU Directive 2019/1023.

  • The Registrar must collect and aggregate data annually on procedures taken under Parts 8, 9, 10, 10A and 11 of the Companies Act 2014, covering restructuring, examinership, receivership, winding up and related processes.
  • This obligation arises from Article 29 of EU Directive 2019/1023, which aims to increase the efficiency of restructuring, insolvency and debt discharge procedures across member states.
  • Data collection commenced for the full calendar year starting 1 January 2023 and ending 31 December 2023, and continues for every full calendar year thereafter.
  • The data must be both collected and aggregated, meaning the Registrar is responsible not only for gathering the raw information but also for compiling it into consolidated form on an annual basis.
