Membership of Authority

Section 944F sets out the rules governing the composition of the Corporate Enforcement Authority, including how Members are appointed, the duration of their terms, transitional arrangements for the former Director, and the conditions of their service.

  • The Authority comprises up to 3 full-time Members appointed by the Minister on the recommendation of the Public Appointments Service for a maximum term of 5 years, with one possible reappointment.
  • The person who held the office of Director immediately before the establishment day automatically became a Member for the remainder of their existing term, on no less favourable terms and conditions.
  • The Public Appointments Service must be satisfied that any recommended candidate has the qualifications, experience and skills necessary for the Authority to perform its functions effectively.
  • Members must comply with Ministerially determined terms and conditions, may not hold other paid positions without consent, and must retire at age 70 (subject to certain exceptions for new entrants appointed on or after 1 April 2004).
