Language of claims in relation to insolvency proceedings outside the State

Section 1427 extends the language requirements for submitting claims in insolvency proceedings to cover foreign insolvency proceedings, not just those within the State.

  • The language rules for claims set out in Section 714 are extended to cover insolvency proceedings outside the State.
  • Section 714 originally applies to insolvency proceedings within the State under the EU Insolvency Regulation framework.
  • This section ensures consistent language requirements whether the insolvency proceedings are domestic or foreign.
  • The provision originates from the European Communities (Corporate Insolvency) Regulations 2002 (S.I. No. 333 of 2002).
