Acting Director of Corporate Enforcement

Section 948 made provision for the Minister to appoint an acting Director of Corporate Enforcement when the Director was unable to perform duties, was suspended, or when the office was vacant. This section has since been repealed.

  • The Minister could appoint an acting Director of Corporate Enforcement in specified circumstances, such as incapacity, suspension, or a vacancy in the office.
  • The acting Director would carry out all the functions of the Director of Corporate Enforcement during the period of appointment.
  • This ensured continuity in the enforcement of company law obligations even when the permanent Director was unavailable.
  • Section 948 was repealed by the Companies (Corporate Enforcement Authority) Act 2021, which replaced the Office of the Director of Corporate Enforcement with the Corporate Enforcement Authority.
