Liquidator to report on conduct of directors

Section 682 requires the liquidator of an insolvent company to report to the Corporate Enforcement Authority on the conduct of the company's directors, and obliges the liquidator to cooperate with any follow-up enquiries by the Authority.

  • The liquidator of an insolvent company must submit a prescribed report to the Corporate Enforcement Authority within six months of appointment, with further reports at intervals as the Authority requires.
  • The Authority may question the liquidator β€” orally or in writing β€” about the report's contents, the company's affairs, or the conduct of any director.
  • The liquidator must also provide reasonable assistance to the Authority in appraising the report or examining any facts or allegations arising from it.
  • A liquidator who fails to submit the required report or comply with the Authority's requests commits a category 3 offence.
