Scope of disclosure order

Section 803 sets out the scope of what a disclosure order may require from the person to whom it is addressed, including the types of information about interests in shares and debentures that must be disclosed to the court.

  • A disclosure order can require a person to provide details of their own past or present interest in a company's shares or debentures during a specified period
  • Where the person currently holds an interest and another interest also exists in the same shares or debentures, they must disclose what they know about that other interest
  • Where the person's interest is a past interest, they must identify (so far as they know) the person who held the interest immediately after them
  • The order must specify the information sought, and all responses must be provided to the court in writing
