Availability of independent expert's report

Section 516 deals with the right to obtain copies of the independent expert's report prepared during an examinership, and the circumstances in which certain information may be withheld from those copies.

  • The independent expert must provide a copy of their report to the company or any interested party upon written request.
  • The court may direct that certain parts of the report be omitted from copies supplied to the company or interested parties.
  • In particular, the court may order the removal of any information whose disclosure would be likely to prejudice the company's survival as a going concern.
  • Where the company is a regulated financial services company and the Central Bank is not presenting a petition, the expert must supply a full, unredacted copy of the report to the Central Bank as soon as practicable.
