Companies Act 2014 section 757

Court may make order in relation to default in production of books or documents, etc.

Section 757 deals with the court's power to intervene when a person fails or refuses to cooperate with court-appointed inspectors during a company investigation, including failing to produce documents, attend before inspectors, or answer their questions.

• Where a company officer, agent, or other relevant person refuses or fails to produce documents, attend before inspectors, or answer questions during an investigation, the inspectors may certify that failure to the court
• The court must first enquire into the case, hear any witnesses produced for or against the defaulting person, and hear any statement made in that person's defence before making any order
• After conducting its hearing, the court may order the person to attend or re-attend before the inspectors, produce specific documents, or answer particular questions
• Alternatively, the court may direct that the person need not produce a particular document or answer a specific question, providing a degree of protection where appropriate
