Court may make order after considering inspectors' report

Section 760 sets out the powers of the court to make orders after it has considered a report prepared by inspectors appointed to investigate a company's affairs.

• After considering an inspectors' report, the court has broad discretion to make any order it considers appropriate.
• The court may, on its own initiative, order the winding up of a corporate body without needing a petition from another party.
• The court may order a remedy for any person who has suffered a disadvantage as a result of the way the company's affairs were conducted.
• When making any remedial order, the court must take into account the interests of other persons who might be adversely affected by that order.
