Register of disqualified persons

Section 864 requires the Registrar of Companies to maintain a register of persons who have been disqualified from acting as company directors or officers, and sets out the rules for adding and removing entries from that register.

  • The Registrar must maintain a register of disqualified persons based on information received under the notification requirements of the Act.
  • Where a person has been granted full relief from disqualification by the court, their details must not be entered on the register, and any existing entry must be promptly removed.
  • Once a person's disqualification period expires, their details must be removed from the register unless a further disqualification notification has been received.
  • Where a person is subject to multiple disqualification orders with different expiry dates, only the details relating to the expired order or orders are removed; entries for orders still in force remain on the register.
