Requirements for application to court under section 738

Section 739 sets out the notice requirements that must be satisfied when making a court application to restore a company to the register under section 738.

  • Any application to restore a company to the register through the court must be notified to the Registrar, the Minister for Public Expenditure and Reform, and the Revenue Commissioners.
  • Where the application is brought by a creditor, additional notice must be given to the company's officers at the date of dissolution who are known or reasonably ought to be known to the creditor.
  • The Registrar, Revenue Commissioners, or Minister may also direct in writing that other members or officers of the company at the date of dissolution be joined as notice parties to the application.
  • These requirements ensure that all relevant parties β€” particularly those who may be affected by a restoration order β€” are made aware of the application before the court considers it.
