Director's power to examine books and records

Section 558ZN grants the Corporate Enforcement Authority the power to request and examine the books and records of an eligible company involved in a rescue process, and sets out the obligations of those asked to produce them.

  • The Corporate Enforcement Authority may request books and records from the company itself, its process adviser, officers, or any receiver, whether current or former, at any time during or after the rescue period
  • Those asked must produce the records, answer the Authority's questions, provide reasonable assistance, and allow access for inspection and copying
  • Requests cannot relate to a rescue period that ended more than six years before the date of the request
  • Failure to comply with any of these obligations without lawful excuse is a category 2 offence
